On March 12, 1992, the Wagon Wheel Bar was robbed and the bartender, Howard Gibbons, was found dead after being stabbed in the back. Preliminary police investigations led police officers Donald Dibble ("Dibble") and Steven Scholl ("Scholl") to suspect the involvement of appellant Michael Joseph Silva ("Silva") and Brian Loehr ("Loehr"). The officers proceeded to the apartment of Silvas girlfriend, Phyllis Vialpando. They questioned her inside her apartment until she noticed that Silva and his sister, Audrey Gabriel ("Gabriel"), arrived outside the building. The officers went downstairs to speak with Silva. Dibble asked Silva if he would mind accompanying him and Scholl to the police station. Silva cooperated and went with them while Gabriel followed in her car.
